The bidder must confirm the mandatory exclusion grounds in the tender passport, including convictions for participation in a criminal organisation, corruption, money laundering or terrorist financing, child labour and other forms of human trafficking, fraud, and terrorist offences. The bidder must also confirm that it does not use a subcontractor that would have to be replaced under the Public Procurement Act and that it does not involve subcontractors or suppliers subject to the EU sanctions restriction described in the tender documents. If an exclusion ground exists, the bidder may need to provide evidence of self-cleaning where allowed.

The bidder must demonstrate technical and professional capability with at least one previous works contract completed within the 60 months before the start of the procurement. The requirement can be met in either of two ways: either the bidder has fully constructed or fully reconstructed drainage network ditches totalling at least 10 km and culverts with a diameter of at least 400 mm totalling at least 10 units, or the bidder has fully carried out renewal or maintenance of a land improvement system in a scope of at least 50 km of ditch restoration and at least 50 culvert maintenance operations. Ditch works must definitely include brush cutting or mowing along ditch banks and removal of vegetation, flow obstructions and sediment from watercourses and sedimentation basins; culvert maintenance must definitely include removal of sediment and restoration of covers and end sections. The bidder must provide in the tender passport data on completed contracts and, if requested by the contracting authority, also a list of the main works and confirmations from the client or main contractor that the work was performed properly. If the bidder relies on the resources of another company, the bidder must also submit that company’s details and consent. The tender must comply with the tender documents, be unconditional, and include the required tender guarantee of EUR 500 valid at least until the end of the tender validity period.
