Compliance requirements
The bidder must be excluded from the procurement procedure if the bidder, or a member of its management, administrative or supervisory body, a procurator or another person authorised to represent it, is subject to any of the exclusion grounds listed in § 95(1) points 1–5 of the Public Procurement Act: participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; enabling work for an illegally staying foreign national or violating wage requirements; illegal use of child labour or human trafficking; tax, fee or environmental charge arrears; or breach of an international sanction or a sanction of the Government of the Republic. The bidder must confirm that none of these exclusion grounds apply.
Qualification criteria and exclusion grounds
The bidder must be registered in the business register of its country of establishment or in another equivalent register if required by the laws of that country. For bidders registered in Estonia, the contracting authority checks the data itself; a foreign bidder must submit a copy of a valid registration certificate.
The bidder or its subcontractor must have performed at least 1 contract similar to the subject of the procurement within the last 5 years before the start of the procurement. The bidder must submit a list of the most important contracts performed during the last five years, including their value, dates and the other contracting parties, together with a confirmation that the contracts were performed properly.
The works must be carried out by qualified responsible persons: a designer with at least Level 6 professional qualification as an Electrical Engineer, specialising in building electrical installations and with competence in designing building electrical installations, or an equivalent or better Class B competence certificate with design rights; and a person responsible for managing electrical works with at least a Class B competence certificate. The bidder must submit a list of the responsible persons and copies of documents proving their qualification and competence. A foreign bidder without certificates issued in Estonia must submit the corresponding documents issued under the laws of its country of establishment and a confirmation that it will submit, within one month after signing the contract, the confirmation issued by the Consumer Protection and Technical Regulatory Authority.
