Compliance requirements

The bidder must confirm that none of the exclusion grounds listed in Section 95(1) points 1–3 and 5 of the Public Procurement Act apply, taking into account Section 95(2). The bidder must also confirm that it is not bankrupt or in liquidation, that bankruptcy or liquidation proceedings have not been initiated against it, and that its business has not been suspended or it is not in a similar situation under the law of its country of establishment. The bidder must confirm that it has no tax, fee or environmental charge arrears, and no tax or social security contribution arrears under the law of its country of establishment. The bidder must confirm that its average employee salary during the reference period was more than 70% of the average salary for the same period in the relevant field. The reference period is six calendar months, ending with the penultimate calendar month before the start of the procurement procedure. The bidder must provide a Tax and Customs Board extract, or an equivalent certificate from a competent authority in its home country. In a joint bid, the proof must be submitted for each joint bidder. The bidder must also confirm that it is not a related person to the technical consultant advising the beneficiary on the reconstruction of the apartment building.

Qualification criteria and exclusion grounds

The bidder must be registered for construction activities covering general building works, indoor climate systems, and internal or building-related water supply or sewerage systems. For electrical works, the bidder must also have a registration for electrical works covering the construction, including installation, of electrical installations. The registration requirement does not apply to a foreign bidder, but equivalent competence must be proven where relevant. The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the estimated contract value excluding VAT. By submitting the bid, the bidder must confirm that by the contract date, or within 10 calendar days after contract signature, it can provide a completion security amounting to 5% of the contract value. The security may be provided as a bank or financial institution guarantee, or by depositing the amount to the contracting authority’s account or to a notary account, provided the contracting authority remains the entitled party throughout the construction period. Within the last 60 months, the bidder must have completed at least one comparable construction project with a value of at least half of the estimated contract value excluding VAT. A comparable project means the construction of a building, an extension, or a full-building reconstruction as the main contractor, and it must include at least the construction or reconstruction of the building’s load-bearing and external envelope structures, the construction or reconstruction of a heat-recovery ventilation system, and the construction or reconstruction of a heating system. To prove this, the bidder must provide the building details, the time and value of the work, and whether it met the required scope; it must also provide the number of the occupancy notice or occupancy permit, or a copy of the handover certificate signed by the client and contractor. The team must include a project manager with at least a level 6 construction engineer qualification specialising in building construction, or a level 6 construction manager qualification specialising in general building works. There must also be a site manager with at least a level 5 construction supervisor qualification specialising in general building works. The ventilation and heating systems specialist must have at least a level 6 heating, ventilation and cooling engineer qualification with the relevant management competences, or a level 6 construction manager qualification specialising in indoor climate systems. The water supply and sewerage systems specialist must have at least a level 6 water supply and sewerage engineer qualification, or a level 6 construction manager qualification with the relevant specialisation. For electrical works, a person with at least a class B competence certificate or a level 6 electrical engineer qualification in consumer electrical installations must be involved. The names and certificate numbers of all these persons must be provided, and a foreign bidder may submit evidence of equivalent competence. The bidder must have a quality management system in the construction field that complies at least with EVS-EN ISO 9001, and an environmental management system that complies at least with EVS-EN ISO 14001.
