Compliance requirements
The bidder must confirm that none of the exclusion grounds under Section 95(1) of the Public Procurement Act apply. In practice this means the bidder, and the members of its management, supervisory or administrative bodies, authorised signatories and other persons with authority to represent or control the company, must not have convictions for participation in a criminal organisation, breach of integrity duties, corruption, fraud, terrorist offences, money laundering or terrorist financing. They must also not have convictions for enabling illegal employment of foreigners, violating the conditions for employing foreigners in Estonia, or illegal use of child labour or human trafficking. The bidder must not have tax, environmental charge or social security contribution debts, and the contract must not conflict with international sanctions or sanctions of the Government of Estonia.
Qualification criteria and exclusion grounds
The bidder must be an authorised official reseller of JetBrains software licences in Estonia and provide a manufacturer confirmation that it has the right to sell JetBrains software in Estonia. The bid must be submitted in the form required by the tender documents and must be unconditional. If the bid refers to a standard, technical approval, trademark, type, origin, production method, label or test report, equivalence must be explained where necessary and proof of equivalence must be attached. In the case of a joint bid, a joint bidders’ power of attorney must be included. The detailed pricing form must also be completed, and the names and countries of establishment of any subcontractors processing personal data must be provided if subcontractors are used.
