Compliance requirements
The bidder must confirm the mandatory exclusion grounds, including no final conviction in the last five years for participation in a criminal organisation, corruption, fraud, money laundering or terrorist financing, child labour or other forms of human trafficking, terrorist offences, and other grounds listed in the tender documents. If an exclusion ground applies, the bidder may need to show self-cleaning measures where allowed. The machine-readable notice did not include the full precise list, so the official tender documents must be checked.
Qualification criteria and exclusion grounds
The bidder’s net turnover for the last financial year ended by the start of the procurement must be at least EUR 100,000. Joint bidders may combine their turnover. To prove turnover, the contracting authority may request an extract from the latest annual report or other evidence.
The bidder must provide a list of public road construction contracts completed within the 60 months preceding the start of the procurement. The contracting authority may request confirmation from the client that the works were performed properly. If the bidder relies on the resources of another company, the bidder must also provide that company’s details and, if required, its consent to be jointly and severally liable for the part of the contract performed using those resources.
According to the compliance requirements, the bidder must submit the fully completed HD IV bill of quantities as an Excel file and may not change the work descriptions, quantities, units of measure or other data provided by the contracting authority. If the tender contains business secrets, these must be identified and justified. In the case of a joint tender, separate ESPD documents must be submitted for all joint bidders. If the bidder has authorised persons who are not visible in the business register, their names and personal identification numbers must be provided, or their absence must be confirmed.
