Compliance requirements
The bidder must confirm that none of the mandatory exclusion grounds apply: no convictions for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing; no convictions for enabling illegal employment of a foreign national or violating the conditions of employment of a foreign national in Estonia, including paying less than the statutory wage; no convictions for illegal use of child labour or human trafficking; and no tax, fee, environmental charge, social security contribution or similar debt under the law of the bidder’s country of establishment. The bidder must also confirm that none of the voluntary exclusion grounds apply: no serious or repeated breach of a previous public contract that led to withdrawal, termination, price reduction, damages or a contractual penalty, and no false information or failure to submit required information or additional documents regarding qualification.
Qualification criteria and exclusion grounds
During the 60 months before the start of the procurement, the bidder must have properly performed at least three contracts for similar electrical construction works, and at least one of them must have had a value of at least EUR 40,000 excluding VAT. A list of the contracts must be submitted, including the performance period, details of the other contracting party, including the client representative’s contact details, and, in the case of public procurement, the reference numbers. The contracting authority may request evidence of proper performance if it cannot obtain the information itself from public or its own databases. In addition, the bidder must have a lead electrical worker with valid A-level competence or a qualification corresponding to at least level 6 under the Vocational Education Institutions Act, with the relevant certificate at the time of submission and entered into the EPP system before the opening of tenders. The bid must also include the price table in the form required by the tender documents, with all unit price fields completed. The bidder must provide the names of the contract signatory or signatories and the contact person, and attach a power of attorney if the signing authority does not arise from the articles of association.
