Compliance requirements
The bidder must confirm that neither it nor its management or authorised representatives have been convicted of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or financing of terrorism. They must also have no convictions related to illegal employment of foreign nationals, breaches of foreign workers’ employment conditions, child labour or human trafficking.
The bidder must not have outstanding state taxes, duties or environmental charges, or tax or social security contribution debts in its country of establishment.
The bidder may also be excluded if it has previously materially or repeatedly breached an earlier public contract, leading to termination, price reduction, damages or contractual penalties, or if it has submitted false information about exclusion grounds or qualification requirements.
The bidder must submit the declaration of absence of exclusion grounds on the HD Annex 5 form. In a joint bid, all joint bidders must submit the declarations.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register of an EU Member State, an EEA contracting state or a WTO GPA member state, if this is required by the laws of the bidder’s country of establishment. An Estonian bidder does not need to submit a copy of the registration certificate.
The bidder may rely on the capacities of another entity, but then it must provide details of that entity and also submit that entity’s declarations on the HD Annex 5.1 form.
The bidder must prove that during the 60 months before the start of the procurement it has completed at least 2 contracts for the construction and/or repair of medium- and/or low-voltage power lines. The works must have been accepted and must not have involved any material breaches. Across those contracts, at least 2 medium-voltage pole-mounted or prefabricated substations must have been built in total. The information must be submitted on the HD Annex 5 form, and the contracting authority may request a confirmation from the client.
For contract performance, the bidder must involve an electrical works project manager. The project manager must meet either the requirements of electrical field competence class A, or equivalent requirements, or hold at least the professional qualification of Electrical Engineer, level 6, with specialisation in Power Networks and Systems and competence in construction and operation of primary power network equipment, or equivalent. The project manager’s details must be submitted on the HD Annex 5 form. If the qualification cannot be checked in the public register, the contracting authority may request a copy of the document proving the qualification. If the team member is not the bidder’s employee, the bidder must also submit that person’s declarations on the HD Annex 5.1 form. A foreign professional certificate must, where required, have undergone the control or recognition procedure of the Estonian competent authority (TTJA), or proof must be provided that an application for recognition has been submitted. The certificate or its recognition must remain valid for the entire contract period.
