Compliance requirements

The bidder must confirm that neither it nor its management board members, procurators or other authorised representatives have been convicted of participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing. They must also not have convictions related to illegal employment of foreign nationals, breaches of foreign workers’ employment conditions, or illegal use of child labour. The bidder must not have unpaid state taxes, fees or environmental charges, nor tax or social security contribution debts under the law of its country of establishment. Awarding the contract must not violate an international sanction or a sanction of the Government of the Republic. The contracting authority may also exclude a bidder if it has previously materially or repeatedly breached essential contract terms, or if it has submitted false information about exclusion grounds or qualification conditions, or failed to submit the required data and documents. The bidder must submit a declaration of no exclusion grounds on HD Appendix 5. In the case of a joint bid, all joint bidders must submit the declaration.

Qualification criteria and exclusion grounds

The bidder must be registered in the commercial register of an EU Member State, an EEA contracting state or a WTO GPA member country, if this follows from the bidder’s home-country law. An Estonian bidder does not need to submit a copy of the registration certificate, but the contracting authority may request it from others. If the bidder relies on the capacities of another company, it must provide the details of that entity and also submit that entity’s confirmations on the HD Appendix 5.1 form. During contract performance, the bidder must involve a responsible electrical works project manager. The project manager must either meet the electrical field A competence class or an equivalent requirement, or hold at least the professional qualification Electrical Engineer level 6, specialising in power networks and systems, with competencies covering at least the construction, operation and supervision of electrical installations. The project manager’s details must be submitted on HD Appendix 5. If the professional certificate cannot be checked in the public register, a copy of the certificate must be submitted on the contracting authority’s request. If the team member is not the bidder’s employee, a confirmation of no exclusion grounds and willingness to participate in contract performance must also be provided. A foreign professional certificate must, where required, have gone through the TTJA recognition or verification procedure, or an application for recognition must have been submitted. The certificate or its recognition must remain valid for the entire contract period.
