Compliance requirements
The tender documents state mandatory and voluntary exclusion grounds. The bidder must confirm that none of the listed mandatory grounds apply, including convictions related to organised crime, corruption, fraud, terrorist offences, money laundering or terrorist financing, illegal employment of foreign nationals, child labour or human trafficking, and tax or social security debt. The bidder must also confirm that none of the listed voluntary grounds apply, such as serious or repeated breach of a previous public contract or false statements or missing documents in relation to qualification requirements.
Qualification criteria and exclusion grounds
During the 60 months preceding the start of the procurement, the bidder must have properly performed at least three contracts for electrical construction works similar to the subject of the contract, and at least one of them must have had a value of at least EUR 40,000 excluding VAT. A list of the contracts must be submitted, including the performance period, the other contracting party’s contact details and, in the case of public procurements, the reference numbers. The contracting authority may request evidence of proper performance. In addition, the bidder must have a person leading electrical works with a valid A-level competence or, under the Vocational Education Institutions Act, a qualification corresponding to at least level 6, who holds the relevant proof at the time of submission and has been entered into the EPP environment before the opening of tenders. The bidder must also have a worker with switching authorisations for switching operations related to the works in the 0.22–20 kV electricity network; if only low-voltage works of 0.22–1 kV are procured, at least MV switching authorisations are sufficient, otherwise both MV and HV switching authorisations are required. There must also be a person designated as responsible for the work operation, entered into the EPP environment before the opening of tenders. The bid must include the pricing table and, where applicable, a power of attorney if representation rights do not arise from the articles of association. The machine-readable notice did not include any more precise requirements; they must be checked in the official tender documents or tender documents.
