Compliance requirements
The exclusion grounds mainly concern tax debt and a domestic-law restriction based on the bidder’s place of residence or establishment. The contracting authority may refuse to sign the contract with a bidder that has a debt for state tax, local tax or environmental charge. If such a debt is found, the contracting authority may give at least three working days to pay or defer the debt and may ask for an explanation. For the successful bidder, tax debt is checked before contract signature. In the case of joint bidders, each joint bidder is checked separately. The bidder must also confirm whether its place of residence or establishment complies with any restriction set by the contracting authority in the procurement documents.
Qualification criteria and exclusion grounds
The bidder must provide several confirmations and proofs for compliance. As of the bid submission date, it must hold a valid occupational health service operating licence, and the licence must cover service delivery in Tallinn, Tartu, Pärnu, Jõhvi and Rakvere. A foreign bidder must have the registration or licence required under the law of its country of establishment and must provide evidence of this; it must have the Estonian operating licence by the time it starts providing the service in Estonia. If subcontractors are used, they must also hold a valid operating licence for occupational health services at the place where the service is provided. The bidder must ensure an electronic self-service environment or another secure electronic solution for sending health examination invitations and employee lists, and must submit a description of the service ordering process. Health examinations must take place during working hours at a suitable location in Tallinn, Tartu, Pärnu and either Jõhvi or Rakvere, access for persons with disabilities must be ensured, and psychological counselling in Tallinn and Tartu must be provided as face-to-face appointments. The bidder must confirm that social aspects are taken into account in service delivery, that the service is accessible to persons with disabilities, and that special aids are available where needed for people with hearing or visual impairments. In the case of a joint bid, a joint bidder authorisation must be submitted. The bidder must describe any business secrets contained in the bid or confirm that the bid contains no business secrets. During contract performance, only subcontractors and suppliers established in Estonia, another EU Member State, another EEA contracting state or a country that has joined the WTO Government Procurement Agreement may be used. If there are managing or authorised persons not visible in the register, their names and personal identification codes must be provided, or the bidder must confirm that no such persons exist. The bidder must also confirm that it prefers environmentally friendly solutions when performing the work.
