Compliance requirements

Mandatory exclusion grounds: the bidder is excluded if it, or a member of its management, administrative or supervisory body, a procurator or another person authorised to represent or control it, has been convicted of participation in a criminal organisation, breach of integrity duties, corruption, fraud, a terrorist offence or other terrorism-related offence, money laundering or terrorist financing. The bidder is also excluded if it, or such a representative, has been convicted of enabling illegal employment, violating the conditions for the employment of a foreign national, illegal use of child labour, or an act related to human trafficking. Another exclusion ground is tax, fee or environmental charge arrears, or social security contribution arrears under the law of the country of establishment. Voluntary exclusion grounds: the bidder may be excluded if it has seriously or repeatedly breached an essential term of a previous public contract so that the contract was withdrawn from, terminated, the price was reduced, damages were compensated or a contractual penalty was paid. Exclusion may also follow if the bidder has provided false information about compliance with the qualification criteria or has failed to submit the requested information or additional documents. The bidder must confirm that its place of residence or establishment is not in the Russian Federation or the Republic of Belarus. It must also confirm that the materials, equipment and goods, including components, used in the works are not produced in or originating from the Russian Federation or the Republic of Belarus; the contracting authority may request certificates of origin.

Qualification criteria and exclusion grounds

The bidder must have, within the 60 months before the start of the procurement, at least three properly performed contracts for similar electrical construction works. At least one of those contracts must have a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts, including the performance period, details of the other contracting party, including the client representative’s contact details, and, in public procurement cases, the reference numbers. The contracting authority may request evidence that the similar electrical construction contracts were properly performed. The bidder must have a person managing electrical works with a valid A-competence or, under the Vocational Qualifications Act, a qualification corresponding to at least level 6. This person must have the relevant certificate at the time of bid submission and must be added to Elektrilevi’s partner portal before bid opening. The bidder must also have an employee with switching rights for work-related switching in the 0.22–20 kV electricity network. If only low-voltage works from 0.22–1 kV are procured, at least low-voltage switching rights are sufficient; in other cases, both low-voltage and medium-voltage switching rights are required. This person must be added to the partner portal before bid opening. The bidder must have a person designated as responsible for the work operation, and that person must also be added to the partner portal before bid opening. The bid must include a price table in the format set out in the procurement documents, and all unit price fields must be completed. The bidder must also provide the names and contact details of the signatory or signatories and the contact person for contract performance matters, and a power of attorney if the right of representation does not arise from the articles of association.
