Compliance requirements

The tenderer will be excluded if any of the statutory exclusion grounds under Section 95(1) points 1–5 of the Public Procurement Act apply. In plain language, this covers convictions for participation in a criminal organisation, corruption, fraud, terrorist offences or related offences, money laundering or terrorist financing; offences related to enabling illegal work or violating the conditions for employing foreigners in Estonia, including paying less than the statutory wage; offences related to illegal use of child labour or human trafficking; tax, environmental charge or social security contribution debts; and situations where the contract would breach an international sanction or a sanction of the Government of Estonia. The tenderer must confirm that none of these exclusion grounds apply.

Qualification criteria and exclusion grounds

The bidder must be entered in the business register of its country of establishment, if this is required by the laws of that country. An Estonian bidder does not need to submit a register extract, but a foreign bidder must provide a copy of the document proving registration if its national law requires such registration. The bidder and/or its subcontractor must have completed at least 1 similar contract during the 60 months before the start of the procurement, where the subject was installation and/or construction work for technical systems, such as pump, water or fire extinguishing systems. The bidder must submit a list of the main contracts with the contract name, short description, performance period and the other contracting party. If the bidder relies on a subcontractor, that subcontractor must also be added to the subcontractor table in the register so that the contracting authority can check exclusion grounds. For the works, qualified responsible persons are required: two responsible specialists for security systems, one with at least level 5 competence in “Installation and maintenance of water and foam extinguishing systems” and the other with at least level 5 competence in “Installation and maintenance of fire safety automation”; a person managing electrical works with at least a class B competence certificate or Electrical Engineer level 6 with specialisation in “Electrical installations in buildings”; and a construction engineer with at least Construction Manager level 6 with specialisation in “General construction” or Works Manager level 5. Form 3 and copies of documents proving competence must be submitted. A foreign bidder may submit equivalent documents from its country of establishment and a commitment to provide, within one month after signing the contract, the confirmation issued by the Consumer Protection and Technical Regulatory Authority.
