Compliance requirements
The bidder must not have tax debt, environmental charge debt, or social security contribution debt under the laws of its country of establishment. The machine-readable notice did not include any other precise exclusion grounds; these must be checked in the official tender documents.
Qualification criteria and exclusion grounds
Within the 60 months before the deadline for publication of the contract notice, the bidder must have at least 1 properly completed contract involving railway repair works or construction/reconstruction works. If the experience is based on a framework agreement, contracts or orders concluded and completed under that framework agreement may be used.
To prove this, the bidder must submit the completed contract details on Appendix 3 and a confirmation from the client that the contract was properly performed. Where relevant, Appendix 5 must be submitted if the bidder relies on another entity’s resources, and Appendix 6 must be submitted if joint bidders rely on each other’s resources.
The person responsible for the bidder’s railway repair works must hold at least a level 6 railway engineer professional qualification with the specialisation “Track construction and operation”, or an equivalent qualification. If the qualification was obtained outside Estonia, proof must be submitted. If the occupational standard becomes invalid, the responsible person must meet the new equivalent standard.
The bid must be signed by the bidder’s legal representative or an authorised person, and the price table required by the contracting authority must also be completed. The bid must comply with the requirements in the tender documents and, where necessary, equivalence must be explained and supporting evidence attached.
