Compliance requirements
The tender documents state the standard exclusion grounds under section 95(1)(1)–(5) of the Public Procurement Act: convictions for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing; offences related to illegal employment of foreign nationals or paying less than the statutory wage; offences related to illegal use of child labour or human trafficking; tax, environmental charge or social security arrears; and situations where awarding the contract would breach an international sanction or a sanction of the Government of the Republic. The bidder must confirm that none of these exclusion grounds apply.
Qualification criteria and exclusion grounds
The bidder must be registered in the business register of its country of establishment or in another similar register if required by the laws of that country. For bidders registered in Estonia, the contracting authority checks the data itself.
For technical and professional capacity, the bidder and/or its subcontractor must have performed at least 1 contract similar to the subject of the procurement within the last 60 months before the start of the procurement, with a total value of at least EUR 3,000. Similar work means projects for external water supply, sewerage and internal water supply systems. The bidder must submit a list of the main work contracts, including their value, dates and the other contracting parties, on the form “Contract list”.
The bidder and/or its subcontractor must have qualified responsible persons for carrying out the works, including a construction manager holding the professional certificate “Construction site manager, level 5” or equivalent or better. The bidder must submit copies of documents proving that person’s qualifications and competence. A foreign bidder must submit copies of the certificates issued under the laws of its country of establishment and a confirmation that within one month after signing the contract it will submit the confirmation issued by the Consumer Protection and Technical Regulatory Authority regarding the above-mentioned responsible person’s qualifications and competence.
The tender must be submitted according to the structure set out in the procurement documents, and the calculation of works and costs must also be provided on the form “Calculation form”.
