Compliance requirements
The tender documents include the standard exclusion grounds from the Estonian Public Procurement Act, including convictions for participation in a criminal organisation, corruption and fraud. The bidder or its management, administrative or supervisory body members, representatives or persons with authority to act for the bidder must not have a final conviction within the last five years for these offences, unless the exclusion period has expired. If an exclusion ground applies, the bidder may provide evidence of self-cleaning measures. The notice also includes questions about whether the information is electronically available.
Qualification criteria and exclusion grounds
The bidder’s net turnover from motorboat sales for each of the last three financial years completed before the start of the procurement must be at least EUR 100,000 per year. The bidder must provide data for the last three financial years and, if necessary, evidence where the data is not available from a public register.
Within the 36 months preceding the start of the procurement, the bidder must have completed at least three motorboat sales contracts, each with a value of at least EUR 40,000 excluding VAT. A list of the contracts must be submitted, including the contract value, dates and the other contracting parties.
The bidder must submit a general plan of the sea rescue motorboat and 3D visualisations showing the exterior conditions. The tender must comply with the tender documents and, where necessary, equivalent evidence must be provided.
The bidder must have at least one manufacturer-approved and/or authorised facility in Harju County for maintenance, warranty and repair work for the offered motorboat. A list of these facilities with contact details must be submitted together with the technical description.
The tender must be prepared in Estonian. In the case of a joint tender, an authorised representative must be named and a power of attorney from the joint bidders must be attached. If the bidder relies on the resources of other joint bidders, the tender must include information on the size and nature of the part of the contract to be performed by each joint bidder.
The machine-readable notice did not include any more precise qualification or compliance requirements; these must be checked in the official tender documents or tender documents in full context, if needed for any missing details. The bidder must also confirm compliance with the tender documents and, where applicable, provide equivalent evidence.
