Compliance requirements
The contracting authority will exclude a bidder if any of the following exclusion grounds apply: criminal convictions of the bidder or its management/representation bodies for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing; unlawful employment of a foreign national or breach of the conditions for employing a foreign national in Estonia, including payment below the statutory wage rate; offences related to illegal use of child labour or human trafficking; tax, environmental charge or social security contribution arrears; or a conflict with an international or Government of the Republic of Estonia sanction. The bidder must confirm that none of these exclusion grounds apply.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register or another similar register of its country of establishment; for bidders registered in Estonia, the contracting authority checks the data itself, while a foreign bidder must submit a copy of a valid registration certificate. The bidder and/or its subcontractor must have performed at least one or more contracts similar to the subject matter of the tender within the last 5 years before the start of the procurement, with a total value of at least EUR 40,000. The subject matter of the tender is earthworks, construction and compaction of a crushed-stone base for a structure, installation of concrete slabs and installation of piping. A list of the most important contracts completed during the last five years must be submitted, including their value, dates and the other contracting parties. The bidder and/or its subcontractor must have qualified responsible persons for carrying out the works: a person managing construction works with the qualification of “Construction Engineer, level 6” and/or “Construction Manager, level 6” (or equivalent/higher), and a person managing electrical works with at least Class B competence (or better). Copies of documents proving the qualifications and competence of these persons must be submitted; a foreign bidder must submit the corresponding documents from its country of establishment and a confirmation that it will submit, within one month after signing the contract, the confirmation issued by the Consumer Protection and Technical Regulatory Authority.
