Compliance requirements
Mandatory exclusion grounds include convictions for participation in a criminal organisation, corruption, fraud, terrorism, money laundering or financing of terrorism; convictions for enabling the illegal employment of a foreign national or for violating wage requirements; convictions for illegal use of child labour or human trafficking; and tax, fee, environmental charge or social security contribution debts. Optional exclusion grounds cover serious or repeated breaches of a previous public contract and the submission of false information about qualification or failure to provide requested additional documents. The bidder must confirm that its place of residence or establishment is not in the Russian Federation or the Republic of Belarus, and that the materials, equipment and goods used in the works are not produced in or originating from the Russian Federation or the Republic of Belarus; the contracting authority may request certificates of origin.
Qualification criteria and exclusion grounds
The bidder must have, during the 60 months before the start of the procurement, at least three properly completed contracts for construction works similar to the subject of the contract, of which at least one must be worth at least EUR 20,000 excluding VAT. A list of contracts must be submitted, including the performance period, details of the other contracting party, and reference numbers in the case of public procurements. The contracting authority may request evidence of proper performance of those contracts. By the bid submission deadline, the bidder must be registered in the Business Register under EMTAK 42111. The bid must confirm compliance with the procurement documents and include a completed price quotation form. If the bid is joint, a joint bidders' power of attorney must be attached. The bidder must also provide the names and contact details of the signatory or signatories and the contact person, and a power of attorney if signing authority does not arise from the articles of association.
