Compliance requirements
The bidder must confirm the absence of exclusion grounds. The notice lists criminal convictions of the bidder or its management/representation/control persons for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing; convictions for illegal employment of a foreign national or breach of conditions for employing a foreign national in Estonia, including payment below the statutory wage rate; convictions for illegal use of child labour or human trafficking; tax, duty or environmental charge arrears, or social security contribution arrears under the law of the bidder’s country of establishment; and situations where awarding the contract would breach an international sanction or a Government of Estonia sanction under the International Sanctions Act. The contracting authority may also exclude a bidder for serious or persistent breach of a previous public contract, or if false information was provided or required documents were not submitted. The bidder must submit confirmations on the absence of exclusion grounds on the HD Annex 5 form; in a joint tender, each joint bidder must submit the confirmations relevant to it.
Qualification criteria and exclusion grounds
The bidder must be registered in the business register of an EU Member State, an EEA contracting state or a WTO GPA member state, if this is required by the laws of the bidder’s country of establishment. An Estonian bidder does not have to submit a copy of the registration certificate, although the contracting authority may request it.
The financial requirement is that the bidder’s net turnover from the sale and/or installation of traffic signs, information boards, pipe barriers, signs and/or stickers must have totalled at least EUR 60,000 excluding VAT during the last three financial years ended by the time the tender was opened for this procurement (2023, 2024, 2025). If the financial year is not 1 January to 31 December, the bidder must provide data for its corresponding financial years.
If the bidder relies on the capacities of another entity, it must provide details of that entity and also submit that entity’s confirmations on the HD Annex 5.1 form.
For the tender, the bidder must submit the HD Annex 2 application for participation. The tender price must be submitted in euros according to the structure set out on the worksheet “Award criteria and evaluated indicators”. The tender must comply with the requirements in the procurement documents, and where necessary equivalence must be explained and evidence attached. In a joint tender, the power of attorney for the joint bidders’ representative must be attached on HD Annex 4. If the bidder uses equivalent solutions, their equivalence must be proven. The machine-readable notice did not include any more precise qualification or compliance requirements; these must be checked in the tender documents.

The contracting authority may also exclude a bidder for serious or repeated breaches of essential contract terms in previous contracts or for providing false information. The bidder must submit the confirmations on the HD Annex 5 form; in a joint tender, all joint bidders must submit the confirmations relevant to them.
