Compliance requirements

The bidder must confirm the absence of exclusion grounds. The notice lists exclusion grounds for criminal offences, illegal employment of foreigners, illegal use of child labour or human trafficking, tax or social security debt, and breach of international or government sanctions. The contracting authority may also exclude a bidder for serious or repeated breach of a previous public contract, or if false information or missing documents were provided about exclusion grounds or qualification compliance. In a joint tender, all joint bidders must submit the required confirmations on the prescribed form.

Qualification criteria and exclusion grounds

The bidder must be registered in the business register of an EU, EEA or WTO GPA member state, if this is required by the laws of the bidder’s country of establishment. An Estonian bidder does not need to submit a copy of the registration certificate if the information is publicly available. The bidder’s net turnover in truck maintenance and repair must have been at least EUR 100,000 per year, excluding VAT, in each of the last three financial years ended by the start of the tender procedure. The requirement applies regardless of which lot or lots the bidder tenders for. If the financial year is not 1 January to 31 December, the bidder must provide turnover data for the relevant financial year periods. The bidder must be able to carry out maintenance and repair work in a stationary workshop in Tallinn or within 20 km of the city boundary, and in Tartu or within 20 km of the city boundary, or have written agreements for this purpose. If the workshop does not belong to the bidder, the bidder must confirm the agreement with the workshop owner and provide the workshop address and contact details. In a joint tender, all joint bidders must submit the required confirmations. If the bidder relies on the capacities of another undertaking, the bidder must provide details of that entity and also submit that entity’s confirmations. In addition, the bidder must submit the participation application, the tender price in the required structure, and, where applicable, an explanation of equivalence and supporting evidence for equivalent solutions or products.
