Compliance requirements
The machine-readable notice includes exclusion grounds and bidder confirmations, but the precise conditions and the verification procedure are described in the tender invitation and tender documents. The bidder must confirm that none of the exclusion grounds under § 95(1) points 1–3 and 5 of the Public Procurement Act apply, that it is not bankrupt or in liquidation and no insolvency or liquidation proceedings have been opened against it, that it has no tax, fee or social security contribution debts under the law of its country of establishment, and that it is not a related person to the technical consultant Meelis Kärvet. For a joint bid, each joint bidder is treated as a bidder and the checks apply to each of them. The bidder must also provide a Tax and Customs Board extract or an equivalent certificate from the competent authority in its home country showing that the average salary of its employees during the reference period was above 70% of the average salary in the relevant field.
Qualification criteria and exclusion grounds
The bidder must be registered in the business register for the activity of construction, covering general building works, indoor climate systems, and internal or associated water supply or sewerage systems. When electrical works are performed, the bidder must also have a registration for electrical works covering the construction, including installation, of electrical installations. The registration requirement does not apply to a foreign bidder, but equivalent competence must be demonstrated where relevant.
The bidder’s net turnover for the financial year preceding the start of the procurement procedure must be at least equal to twice the estimated contract value excluding VAT. In a joint bid, it is sufficient if at least one joint bidder meets this requirement on its own.
Within the 60 months before publication of the procurement procedure, the bidder must have carried out at least one equivalent construction project with a value of at least half of the estimated contract value excluding VAT. An equivalent project means the erection, extension or full reconstruction of a building as the main contractor, and it must include at least the construction or reconstruction of the load-bearing and external envelope structures, the construction or reconstruction of a heat-recovery mechanical ventilation system, and the construction or reconstruction of a heating system. Completion must be evidenced by a handover-acceptance certificate signed by the client and contractor, or by the number of the occupancy notice or occupancy permit in the building register.
The team must include a project manager, site manager, ventilation and heating systems specialist, water supply and sewerage systems specialist, and a person competent to perform electrical works. The project manager must hold at least a level 6 construction engineer qualification with specialisation in building construction or a level 6 construction manager qualification with specialisation in general construction. The site manager must hold at least a level 5 construction foreman qualification with specialisation in general construction works. The ventilation and heating systems specialist must hold at least a level 6 heating, ventilation and cooling engineer qualification with the relevant competencies or a level 6 construction manager qualification with specialisation in indoor climate systems. The water supply and sewerage systems specialist must hold at least a level 6 water supply and sewerage engineer qualification or a level 6 construction manager qualification with specialisation in the construction of internal or associated water supply and sewerage systems. For electrical works, the person involved must have at least a category B competence certificate or a level 6 electrical engineer qualification in consumer electrical installations. The name and professional certificate number of each such person must be provided, and they must be involved in carrying out the works.
The bidder must also be able to provide a performance security equal to 5% of the contract value by the contract date or within 10 calendar days after contract signature, and the bid must include the required forms and powers of attorney where applicable, as well as confirmation of acceptance of the tender documents and any equivalent solutions supported by evidence.
