Compliance requirements
The tenderer must confirm that none of the exclusion grounds listed in the Public Procurement Act § 95(1) points 1–5 apply. These cover, in plain language, convictions for organised crime, corruption, fraud, terrorism-related offences, money laundering or terrorist financing; offences related to employing foreigners illegally or paying less than the statutory wage; child labour or human trafficking; tax, social security or environmental charge arrears; and situations where the contract would breach an international or Government of the Republic sanction. The notice also requires a confirmation that the tenderer will not use a subcontractor that would have to be replaced under § 122(7).
Qualification criteria and exclusion grounds
The bidder must be registered in the business register of its country of establishment or another equivalent register; for bidders registered in Estonia, the contracting authority checks the data itself, while a foreign bidder must submit a copy of a valid registration certificate.
For technical and professional capacity, the bidder and/or its subcontractor must have, during the last 60 months, built and/or reconstructed at least 1 km of pre-insulated district heating pipeline, including at least one construction and/or reconstruction job with a pipeline diameter of at least DN 200 mm. A similar job is defined as underground installation of steel pre-insulated district heating pipeline. The bidder must submit a list of similar works performed during the last 60 months, showing the time and place of performance, the client’s contact details and the scope of work, together with a confirmation that the works were carried out in accordance with the contracts and good construction practice and were completed and accepted by the client.
The bidder’s team must include: a welding coordinator with certification according to EVS-EN ISO 14731 or EN1091; at least two welders with certification according to EVS-EN ISO 96061 for welding process 111; a project manager with at least a Level 7 certified qualification as a certified thermal energy engineer; a site manager with at least a Level 6 qualification as a thermal energy engineer; and at least 2 specialists for soldering/installation of pre-insulated pipe joint couplings with a valid training certificate issued by the Estonian Association of Power Plants and District Heating or an equivalent body. For the responsible persons, form 3 and copies of documents proving qualification and competence must be submitted; a foreign bidder may submit equivalent documents from its country of establishment and a confirmation that it will provide, within one month after signing the contract, the confirmation issued by the Consumer Protection and Technical Regulatory Authority.
If the bidder intends to use subcontracting, form 4 must be submitted with information on the size and nature of the subcontracted part. The bidder must also confirm the existence of an ISO 9001 or equivalent quality management system and provide a document proving compliance with that requirement.
