Compliance requirements
The bidder must confirm that none of the mandatory exclusion grounds apply: no convictions for participation in a criminal organisation, breach of integrity duties, corruption, fraud, terrorist offences or related offences, money laundering or terrorist financing; no convictions for enabling illegal employment of a foreign national staying without legal basis or for violating the conditions of foreign nationals’ employment in Estonia, including paying less than the statutory wage; no convictions for illegal use of child labour or human trafficking; and no tax, duty, environmental charge, or social security contribution arrears under the law of the bidder’s country of establishment. The bidder must also confirm that none of the optional exclusion grounds apply, in particular no serious or persistent breach of a previous public contract and no false information or failure to submit required documents regarding qualification.
Qualification criteria and exclusion grounds
Within the 60 months before the start of the procurement, the bidder must have properly performed at least three contracts for electrical construction works similar to the subject of the contract, and at least one of them must have had a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of contracts showing the performance period, details of the other contracting party, including the client representative’s contact details, and, in the case of public procurement, the reference numbers. On the contracting authority’s request, evidence of proper performance of these contracts must be provided. A completed price table must also be submitted. In addition, the bidder must have a person managing electrical works with valid A-level competence or a qualification corresponding to at least level 6 under the Vocational Education Institutions Act, who holds the relevant certificate at the time of submission and has been added to the EPP environment before the opening of tenders. If only low-voltage works from 0.22 to 1 kV are procured, at least low-voltage switching rights are required; in other cases, both low-voltage and medium-voltage switching rights are required. There must also be a person designated as responsible for work operations, added to the EPP environment before the opening of tenders. The bidder must provide the names and contact details of the contract signatory and the contact person, and a power of attorney if authority does not arise from the articles of association.
