Compliance requirements
Mandatory exclusion grounds: the bidder is excluded if it or one of its management, administrative or supervisory body members, a procurator or another authorised representative has been convicted of participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing; if there is a conviction for enabling illegal employment of a foreign national or for violating the conditions for employing a foreign national; if there is a conviction for illegal use of child labour or trafficking in human beings; if the bidder has tax, duty or environmental charge arrears, or tax arrears in its country of establishment; or if the contract would breach an international sanction or a Government of the Republic of Estonia sanction.
Voluntary exclusion grounds: the contracting authority may exclude a bidder that has seriously or persistently breached a previous public contract so that the contract was terminated, rescinded, the price was reduced, damages were paid or a contractual penalty was imposed; or a bidder that has provided false information about compliance with the selection criteria or failed to submit the required information or documents.
The bidder must confirm that its place of residence or establishment is not in the Russian Federation or the Republic of Belarus. It must also confirm that the materials, equipment and goods, including components, used in the works are not produced in or originating from the Russian Federation or the Republic of Belarus; the contracting authority may request certificates of origin.
Qualification criteria and exclusion grounds
The bidder’s net turnover for each of the last three completed financial years must be at least EUR 300,000. The bidder must submit extracts from the last three completed annual accounts showing the turnover.
During the 60 months before publication of the contract notice, the bidder must have properly performed at least three contracts for similar electrical construction works, and at least one of them must have had a value of at least EUR 80,000 excluding VAT. A list of the contracts must be submitted, including the performance period, the other contracting parties’ details and, for public procurement contracts, the reference numbers. The contracting authority may also request evidence of proper performance.
The bidder must have a person in charge of electrical works with a valid A-level competence or a qualification corresponding to at least level 6 under the Vocational Education Institutions Act, who has the relevant certificate at the time of submission and is entered in Elektrilevi’s partner portal before the opening of tenders.
The bidder must have an authorised person responsible for work operations, with valid rights, entered in Elektrilevi’s partner portal before the opening of tenders.
The bidder must have a worker with switching rights for switching operations related to the works in the 0.22–20 kV electricity network. If only low-voltage works of 0.22–1 kV are procured, at least low-voltage switching rights are required; in other cases, both low-voltage and medium-voltage switching rights are required. This person must also be entered in Elektrilevi’s partner portal before the opening of tenders.
The bidder must provide the names, job titles and contact details of the person(s) signing the contract and the name, job title and contact details of the contact person for contract performance matters. If the right of representation does not arise from the articles of association, a power of attorney must be included.
The bid must include the price table in the format required by the procurement documents, and all unit price fields must be completed.
The bidder must confirm that the bid complies with the conditions set out in the procurement documents and that no conditional bid has been submitted.
