Compliance requirements

The bidder must confirm that neither it nor members of its management, representative or supervisory bodies have been finally convicted within the last five years for participation in a criminal organisation, corruption or fraud. Where applicable, the bidder must also confirm that self-cleaning measures have been taken to restore reliability. The tender documents also require confirmation that no subcontractor subject to replacement under Section 122(7) of the Public Procurement Act will be used, and that subcontractors and suppliers from the Russian Federation, or controlled by or acting on the instructions of such persons, entities or undertakings, will not account for more than 10% of the contract value. In addition, the offered goods must not be subject to international sanctions and must not originate from sanctioned regions.

Qualification criteria and exclusion grounds

The bidder must have, within the 60 months before the start of the procurement, completed at least one relevant construction contract as the main contractor or as a subcontractor carrying out or organising all works. The required total scope is at least 1 km or 5,000 m2, and the work must have been a fully completed or fully reconstructed land improvement system, publicly used road or forest road. The bidder must provide the contract data in the ESPD and, on the contracting authority’s request, the authority’s prescribed form and a confirmation from the client or main contractor that the work was performed properly. If the bidder relies on the resources of another undertaking, the details and consent of that undertaking must also be submitted. In addition, the bidder must involve at least one responsible person holding the professional qualification “Road Engineer, level 6”, specialising in roads, or an equivalent or higher qualification; alternatively, there must be a corresponding legal relationship under Section 36 of the Land Improvement Act or an equivalent legal basis elsewhere. The tender must comply with the tender documents, and conditional tenders are not allowed.
