Compliance requirements
Mandatory exclusion grounds relate to participation in a criminal organisation, corruption, fraud, terrorism, money laundering, illegal employment of foreign nationals, child labour and human trafficking, as well as tax and social security debt. The bidder must confirm that none of these grounds apply to it or to the members of its management, administrative or supervisory bodies, or its authorised representatives. The contracting authority may also exclude a bidder that has seriously or repeatedly breached an earlier public contract, or that has provided false information about qualification conditions or failed to submit required information or documents. The bidder must also confirm that its place of residence or establishment is not in the Russian Federation or the Republic of Belarus.
Qualification criteria and exclusion grounds
Within the 60 months before the start of the procurement, the bidder must have properly performed at least three contracts for electrical construction works similar to the subject of the contract, and at least one of them must have had a value of at least EUR 40,000 excluding VAT. The bidder must provide a list of the contracts showing the performance period, the other contracting parties and, in public procurement cases, the reference numbers. On request, the bidder must provide evidence that the similar electrical construction contracts were properly performed, unless the contracting authority can obtain the information from public or its own databases without major cost. In addition, the bidder must have a person in charge of electrical works with valid A-level competence or a qualification corresponding to at least level 6 under the Occupational Qualifications Act; this person must have the relevant proof at the time of submitting the tender and must be entered in the EPP environment before the opening of tenders. The bidder must also have a worker with switching rights for switching operations in the 0.22–20 kV electricity network; if only low-voltage works 0.22–1 kV are procured, at least low-voltage switching rights are sufficient, otherwise both low-voltage and medium-voltage switching rights are required. A person responsible for the work operation must also be appointed and entered in the EPP environment before the opening of tenders. The tender must include the completed price table, the details of the contract signatory and the contact person, and, where necessary, a power of attorney. The bidder must confirm that its place of residence or establishment is not in the Russian Federation or the Republic of Belarus, and that the materials, equipment and goods used in the works are not produced in or originating from the Russian Federation or the Republic of Belarus; the contracting authority may request certificates of origin.
