Compliance requirements
The tenderer will be excluded if the tenderer, or a member of its administrative, management or supervisory body, a procurator, or another person authorised to represent or control the company, has been convicted of participation in a criminal organisation, breach of integrity obligations, corruption, fraud, a terrorist offence or related incitement, aiding or attempt, money laundering, or terrorist financing. Exclusion also applies if such persons have been convicted of enabling work for an illegally staying foreign national, or of violating the conditions for employing a foreign national in Estonia, including paying less than the statutory wage rate, or of illegal use of child labour or human trafficking. The tenderer is also excluded if it has tax, duty or environmental charge arrears, or arrears of tax or social security contributions under the law of its country of establishment. The contracting authority may also exclude a tenderer for serious or persistent breach of a previous public contract, or if the tenderer has provided false information or failed to submit required information or additional documents. The tenderer must confirm that none of these mandatory or voluntary exclusion grounds apply.
Qualification criteria and exclusion grounds
Over the 60 months preceding the start of the procurement, the bidder must have properly performed at least three contracts for electrical construction works similar to the subject of the contract, at least one of which must have a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts, including the performance period, details of the other contracting parties, including the client representative’s contact details, and, in the case of public procurement, the reference numbers. On the contracting authority’s request, evidence of proper performance of the similar electrical construction contracts must be provided, unless the contracting authority can obtain the information from public or private databases without significant cost. In addition, the bidder must have a person leading electrical works with valid A-level competence or a qualification corresponding to at least level 6 under the Vocational Education Institutions Act, who holds the relevant certificate at the time of submission and has been added to the Elektrilevi partner portal before the opening of tenders. The bidder must also have a person responsible for the work operation with valid rights, who has been added to the Elektrilevi partner portal before the opening of tenders. The bid must comply with all tender documents, include the price quotation table, and be submitted unconditionally. The bidder must also provide the names and contact details of the contract signatory and the contact person, and a power of attorney if required by the basis of representation if it does not arise from the articles of association. The machine-readable notice did not include more precise compliance requirements; these must be checked in the tender documents. The bidder must also confirm the standard payment term choice and the business secret declaration if applicable.
