Compliance requirements
The bidder must confirm that none of the exclusion grounds listed in the Estonian Public Procurement Act apply to it. These include convictions for corruption, fraud, terrorist offences, money laundering or financing terrorism; offences related to illegal employment of foreign nationals or paying less than the statutory wage; child labour or human trafficking; tax, social security or environmental charge debts; and any situation where the contract would breach an international or Government of the Republic sanction. The machine-readable notice does not provide any additional exclusion grounds.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register or another equivalent register in its country of establishment, if required by that country’s law. For bidders registered in Estonia, the contracting authority will check the data itself.
The bidder and/or its subcontractor must have at least one properly performed contract for industrial premises repair works completed within the last 60 months with a total value of at least EUR 10,000. There must also be at least one properly performed contract for bitumen roof repair works completed within the last 60 months with a total value of at least EUR 10,000. In addition, there must be at least one properly performed contract for electrical equipment design and installation works completed within the last 60 months with a total value of at least EUR 5,000. The relevant contract lists, including values, dates and counterparties, must be submitted for all three experience requirements.
The bidder and/or its subcontractor must have qualified responsible persons for carrying out the works: a person managing construction works with the professional certificate “Construction site manager, level 5” or equivalent; a designer with at least the qualification Electrical Engineer, level 6, specialising in “Building electrical installations” and competent in “Design of building electrical installations” and/or a class B competence certificate with design rights, or equivalent; a person managing electrical works with at least a class B competence certificate or equivalent; and at least one welder certified in accordance with EVS-EN ISO 9606-1. A foreign bidder must submit copies of the documents issued in its country of establishment and a confirmation that, within one month after signing the contract, it will submit the confirmation issued by the Consumer Protection and Technical Regulatory Authority regarding the responsible person’s qualification.
If subcontracting is planned, information on the size and nature of the subcontracted part must also be provided. To confirm compliance, the bidder must submit the tender form, documents proving the technical characteristics of the offered equipment, and, in the case of a joint tender, a power of attorney for the joint bidders.
