Compliance requirements
The tenderer must confirm that none of the mandatory exclusion grounds apply: no convictions for participation in a criminal organisation, breach of integrity duties, corruption, fraud, terrorist offences or related incitement/complicity/attempt, money laundering or terrorist financing; no convictions for enabling illegal employment of a foreign national staying without legal basis or for violating the conditions for employing a foreign national in Estonia, including paying less than the statutory wage rate; no convictions for illegal use of child labour or human trafficking; and no tax, fee or environmental charge arrears, or social security contribution arrears, under the law of the country of establishment. The contracting authority may also exclude a tenderer for serious or persistent breach of a previous public contract, or if false information was provided or required documents were not submitted. The machine-readable notice did not include any more precise exclusion requirements; they must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must have, during the 60 months before the start of the procurement, at least three properly performed contracts for similar electrical construction works, at least one of which must have a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts, including the performance period, details of the other contracting parties, including the client representative’s contact details, and, in public procurement cases, the reference numbers. The contracting authority may request evidence of proper performance if it cannot obtain the information easily from public or its own databases. In addition, the bidder must have a worker with valid switching authorisations for switching operations in the 0.22–20 kV electricity network, a person appointed as responsible for the work operation with valid rights, and a person managing electrical works who has valid A-level competence or at least level 6 qualification within the meaning of the Vocational Education Institutions Act and the relevant certificate. These persons must be entered in the Elektrilevi partner portal before the opening of tenders. The offer must include the price table in the form required by the tender documents, and all unit price fields must be completed. If representation rights are not based on the articles of association, a power of attorney must be included, together with the names and contact details of the signatory(ies) and the contact person. The machine-readable notice did not include any more precise qualification or compliance requirements; they must be checked in the tender documents.
