Compliance requirements
The bidder must confirm that neither the bidder nor its management, representation or supervisory body members have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or any other exclusion grounds listed in the tender documents. If any such ground exists, the bidder may in certain cases provide evidence of self-cleaning measures to restore reliability. The exact list of exclusion grounds and any exceptions must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder must show annual net turnover in software development of at least EUR 2.5 million in each of the last three completed financial years. The information must be provided in the ESPD, and the contracting authority may request supporting evidence.
The bidder must have properly performed at least 2 custom software development contracts during the 36 months before the start of the procurement. Each contract must meet all three conditions: software was developed, the development effort was at least 2,500 person-hours, and the contract value was at least EUR 250,000 excluding VAT. The bidder must provide the subject of the contract, performance period, number of person-hours, contract value, client name and contacts, and, where relevant, the public procurement reference number. The contracting authority may request additional evidence such as client confirmation letters or acceptance records.
For the technical offer, the bidder must submit the project team with role allocation and reference projects, including energy-sector projects. The bidder must also provide a project plan, a description of the work stages, the result and deliverable for each stage, the estimated workload in person-hours for each stage, and a work schedule by month with weekly precision. In addition, the bidder must describe the inputs expected from the contracting authority.
The bid must comply with all tender documents. Conditional bids are not allowed. In a joint bid, an authorised representative must be named and a power of attorney from the joint bidders must be attached. If the bid contains trade secrets, they must be justified, but the bid price may not be marked as a trade secret.
