Compliance requirements
The bidder must confirm that none of the exclusion grounds set out in Section 95(1) and (4) of the Public Procurement Act apply. In practice, this means that neither the bidder nor its management bodies may have relevant convictions, and there must be no disqualifying tax or social security payment issues.
The bidder must also confirm that it will not use a subcontractor in performance of the contract if that subcontractor would have to be replaced under Section 122(7) of the Public Procurement Act.
The bidder must state whether the bid contains trade secrets and justify that classification. The bid price and other numerical indicators used for award evaluation may not be marked as trade secrets.
The bidder must confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned areas. The bidder must also confirm that the bid complies with the tender documents and that no conditional bid is submitted.
Qualification criteria and exclusion grounds
The bidder’s average turnover for the last 3 completed financial years must be at least EUR 3,000,000 per year. If the bidder is not an Estonian company, it must be ready to submit a copy of its annual accounts.
The bidder must have, within the 60 calendar months before the start of the procurement, designed at the working design stage and built two similar or comparable buildings, such as a healthcare or social welfare building, with a net floor area of at least 1,000 m2. A summary of the previous contracts and the contact details of the former clients must be provided so that the contracting authority can verify the references if needed. If the bidder relies on another person’s reference, that person’s digitally signed consent and confirmation of participation in performing the contract must be submitted.
The bidder must have a construction project manager and a construction site manager. The project manager must be at least a certified construction engineer, level 7 or equivalent. The site manager must be at least a construction manager or construction engineer, level 6 or equivalent. The project manager and site manager must be different persons. If another person’s experience is used, that person’s written consent to participate in contract performance must be submitted. In addition, the team must include specialists for indoor climate, high-voltage systems, low-voltage systems, and water and sewerage systems, each with the relevant professional qualification and signed consent to participate.
For bid security, the bidder must provide a guarantee from a credit or financial institution or insurer, or deposit the amount into the contracting authority’s bank account. The security must be up to 1% of the estimated contract value, but not less than EUR 15,000, and its validity period must match the bid validity period.
