Compliance requirements
The bidder must confirm that none of the exclusion grounds under Section 95(1)(1)–(5) of the Public Procurement Act apply. If there has been an early termination of a previous contract, damages or a comparable sanction within the meaning of Section 95(4)(8), this must be described and, where relevant, evidence of self-cleaning measures must be provided. The bidder must also confirm that it is not restricted from submitting a tender or request on the basis of the bidder’s place of residence or establishment, if the contracting authority has imposed such a restriction. The bidder must also confirm that it will not use a subcontractor in contract performance who would have to be replaced under Section 122(7) of the Public Procurement Act.
Qualification criteria and exclusion grounds
The bidder’s net turnover for the last completed financial year among the three years preceding the start of the procurement must total at least EUR 2,000,000. On request, the bidder must provide extracts from the approved annual reports for the last three financial years showing the turnover. Joint bidders may rely on aggregated figures for the turnover requirement, but each participant in the joint bid must submit its own report extracts separately.
Within the last 60 months before the deadline for announcing the tender, the bidder must have properly built and handed over at least 2 similar contracts, in total at least 100,000 m² of asphalt concrete yards with foundations as the main contractor. The bidder must provide a short description of the contracts, the performance period, the client’s name and contact person, and evidence that the work was carried out properly. For a public procurement contract, the procurement number must also be provided.
For contract performance, the bidder must have at least the following key persons: a person responsible for electrical works with the professional certificate of a certified electrical engineer in power networks and systems, EQF level 7, or an electrical engineer with competence A, or an equivalent qualification under the law of the country where the competence, education or professional qualification was obtained; and a project manager with the professional certificate of a certified road engineer, level 7, or an equivalent qualification. If the bidder relies on the resources of another undertaking, it must submit that undertaking’s written and signed consent, and that undertaking must participate directly in contract performance at least in the part on which the bidder relies.
When submitting the tender, the bidder must confirm that the tender complies with the tender documents and, where necessary, that equivalence has been explained and supporting evidence has been attached. The tender price must be submitted in the required structure and the price form must be provided. All bidders must visit the site in person; tenders from bidders who did not attend the site visit will not be considered. During contract performance, an ISO 14001 or equivalent environmental management system recognised in the European Union must be in place, and a valid certificate or equivalent proof must be submitted.
