Compliance requirements
Mandatory exclusion grounds: the bidder is excluded if the bidder, or a member of its administrative, management or supervisory body, a procurator or another person authorised to represent or control the bidder, has been convicted of participation in a criminal organisation, corruption, fraud, a terrorist offence, money laundering or terrorist financing. Exclusion also applies if such a person has been convicted of enabling illegal employment or violating the conditions for employing a foreign national, of illegal use of child labour or of trafficking in human beings, or if the bidder has a tax debt, public charge debt or environmental charge debt, or a tax or social security contribution debt under the law of its country of establishment.
Voluntary exclusion grounds: the contracting authority may exclude a bidder that has seriously or repeatedly breached an essential term of a previous public contract, resulting in termination, cancellation, price reduction, compensation of damages or payment of a contractual penalty. Exclusion is also possible if the bidder has provided false information about compliance with the selection criteria or has failed to submit the required information or documents.
In addition, companies whose place of residence or establishment is in the Russian Federation or the Republic of Belarus are not allowed to participate. During the works, materials, equipment and goods, including components, that are produced in or originate from the Russian Federation or the Republic of Belarus may not be used; the contracting authority may request certificates of origin.
Qualification criteria and exclusion grounds
Within the 60 months before the start of the procurement, the bidder must have properly completed at least three contracts for similar electrical construction works. At least one of those contracts must have had a value of at least EUR 40,000 excluding VAT. The bidder must submit a list of the contracts showing the performance period, the other contracting parties, including the client representative’s contact details, and, in public procurement cases, the reference numbers. On the contracting authority’s request, evidence of proper performance must be provided, unless the authority can obtain the information from public or its own databases without major cost.
The bidder’s team must include a person with valid switching rights who has been entered into Elektrilevi’s partner portal before the deadline for submitting tenders. If only low-voltage works 0.22–1 kV are being procured, at least low-voltage switching rights are sufficient. In other cases, both low-voltage and medium-voltage switching rights are required.
The bidder must have a person appointed as responsible for the work operation, and that person must be entered into Elektrilevi’s partner portal before the tender submission deadline.
The bidder’s team must include an electrical works manager with valid A-competence and/or a qualification corresponding to at least level 6 under the Vocational Education Institutions Act. That person must have the relevant certificate at the time of submitting the tender and must be added to Elektrilevi’s partner portal before the tender submission deadline.
The bidder must provide the names, job titles and contact details of the person or persons signing the contract, as well as the name, job title and contact details of the contact person for matters related to contract performance. If the right of representation does not arise from the articles of association, a power of attorney must be included.
