Compliance requirements
The contracting authority will exclude a bidder or applicant if any of the grounds listed in § 95(1) points 1–5 of the Public Procurement Act apply: criminal offences related to participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing; unlawful employment of a foreign national or breach of the conditions for employing a foreign national in Estonia, including payment below the statutory wage rate; illegal use of child labour or human trafficking; tax, duty or environmental charge arrears, or tax/social security contribution arrears under the law of the bidder’s country of establishment; or if awarding the contract would breach an international sanction or a sanction of the Government of the Republic.
Qualification criteria and exclusion grounds
The bidder and/or its subcontractor must have performed at least two conveyor belt repair service contracts similar to the subject of the tender within the 36 months preceding the start of the procurement, with a total value of at least EUR 15,000. A list of the most important similar contracts must be submitted, including their value, dates and the other contracting parties, using the form ‘List of contracts’. In addition, the bid must be submitted in the form required by the tender documents, the bid price form must be completed, and the bidder must confirm that the bid complies with the conditions set out in the procurement documents. If this is a joint bid, a power of attorney from the joint bidders must be attached. The machine-readable notice did not include any other precise qualification or compliance requirements; these must be checked in the tender documents.
