Compliance requirements
The tender documents include mandatory exclusion grounds. A bidder must confirm that neither the bidder nor its management, supervisory or representative persons have been finally convicted in the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing, or that any exclusion period stated in the conviction has already expired. If an exclusion ground exists, the bidder may be allowed to show self-cleaning measures, if the procurement rules and tender documents allow it. The machine-readable notice does not provide the full list of exclusion grounds, so the official tender documents must be checked.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register. As a financial capacity requirement, the bidder’s net turnover in the last completed financial year before the start of the last three procurement procedures must be at least EUR 100,000 for the years 2023, 2024 and 2025. As a technical capacity requirement, the bidder must have sold at least 3 passenger cars or minibuses during the last 36 months, with each contract having a value of at least EUR 25,000, and those contracts must have been performed. If the information is not available from public databases, the bidder must provide details of the contract values, dates and other contracting parties. Under the compliance requirements, a joint bid must include a power of attorney from the joint bidders, the bid may not be conditional, and the bidder must confirm that the bid complies with the tender documents and, where necessary, that equivalence has been explained and supporting evidence has been attached.
