Compliance requirements
The tender documents state the mandatory exclusion grounds: the bidder must not have convictions for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing; for enabling illegal employment of a foreign national or violating the conditions for employing a foreign national in Estonia, including paying less than the statutory wage rate; or for illegal use of child labour or human trafficking. The bidder must also not have tax, duty or environmental charge arrears, or social security contribution arrears under the law of its country of establishment. The contracting authority may also exclude a bidder for serious or repeated breach of an earlier public contract, or if the bidder has submitted false information or failed to provide required qualification data or additional documents. The bidder must confirm the absence of these grounds. The notice also excludes bidders established in Russia or Belarus and requires confirmation that no materials, equipment or goods used in the works, including components, are produced in or originate from Russia or Belarus; origin certificates may be requested.
Qualification criteria and exclusion grounds
The bidder must have, during the 60 months preceding the start of the procurement, at least three properly performed contracts for electrical construction works similar to the subject of the contract, of which at least one must have a value of at least EUR 40,000 excluding VAT. A list of the contracts must be submitted, including the performance period, details of the other contracting parties, including the client representative’s contact details, such as telephone number and email address, and, in the case of public procurements, the reference numbers. The contracting authority may request evidence of proper performance of the similar electrical construction contracts if it cannot obtain the information easily from public or its own databases. The bid must also include the price table in the required form, and all unit price fields must be completed. The team must include a switching-authorised employee for switching operations in the 0.22–20 kV electricity network, who has been entered into Elektrilevi’s partner portal before the opening of bids; for low-voltage works, at least low-voltage switching rights are sufficient, while in other cases both low-voltage and medium-voltage switching rights are required. There must also be a person appointed as responsible for the work operation, entered into the Elektrilevi partner portal before the deadline for submitting bids. The bidder’s team must include a leading electrical works specialist with valid A-level competence or, within the meaning of the Occupational Qualifications Act, at least level 6 qualification, with the relevant proof available at the time of bid submission and entry into the Elektrilevi partner portal before the deadline. If the bid is submitted as a joint bid, a power of attorney from the joint bidders must be attached. The bidder must also provide the names, job titles and contact details of the signatory or signatories and the contact person for contract performance, and a power of attorney if representation authority does not arise from the articles of association. The bid must be unconditional; conditional bids are not allowed.
