Compliance requirements
The bidder must confirm that neither it nor its management, administrative or supervisory body members, procurators, or persons with representation rights have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, or any other exclusion ground listed in the ESPD. If an exclusion ground applies, the bidder may submit evidence of self-cleaning measures where permitted. The ESPD also asks whether this information is electronically available and whether the bidder can provide the relevant data or evidence.
Qualification criteria and exclusion grounds
The bidder’s team must include a person responsible for construction supervision who will personally take part in performing the contract. This responsible person must have at least the professional qualification of a certified civil engineer, level 7, with the competence of construction supervision, or an equivalent qualification. The person must have at least 5 years of experience as a construction supervision engineer and experience in supervising the construction of at least 2 masts with a metal lattice structure and a height of at least 35 metres during the 48 months before the start of the procurement. The bidder must submit the responsible person’s CV form and, if requested, additional explanations or evidence. The bid must comply with all tender documents; conditional bids are not allowed. In the case of a joint bid, an authorised representative must be appointed and an ESPD must be submitted for each joint bidder. The bidder must also confirm compliance with the required bid structure, equivalent solutions where applicable, proper declaration of business secrets, and the restriction that only subcontractors and suppliers established in the required countries may be used during contract performance.
