Compliance requirements
The exclusion grounds include at least participation in a criminal organisation, corruption and fraud. The bidder or members of its management, administrative or supervisory body, a procurator or other persons authorised to represent it must not have been finally convicted of these offences within the last five years if the exclusion period still applies. If an exclusion ground exists, the bidder may submit evidence of self-cleaning measures where this is allowed. In addition, the bidder must confirm that subcontractors or suppliers representing more than 10% of the contract value will not include citizens, residents or undertakings established in the Russian Federation, or persons linked to them, and that the offered goods are not subject to international sanctions and do not originate from sanctioned territories. The contracting authority may reject the tender if the contract would be void because of sanctions rules.
Qualification criteria and exclusion grounds
The bidder must be entered in the commercial register of its country of establishment and provide proof of registration if the register data are not publicly available to the contracting authority. The bidder’s net turnover for the last financial year ended by the start of the procurement must be at least EUR 100,000; joint bidders may aggregate turnover. The bidder’s project manager must hold the professional qualification of Road Engineer, level 6 (specialisation: road construction and maintenance, selected competence: management of construction activities) or an equivalent EQF level 6 qualification. A completed cost list must be submitted on the prescribed form. The tender must comply with the procurement documents, and if equivalence is relied on, it must be explained and supporting evidence must be attached. In the case of a joint tender, a power of attorney for the joint bidders must be included.
