The bidder must confirm that neither it nor members of its management, representative or supervisory bodies have been finally convicted within the last five years of participation in a criminal organisation, corruption or fraud. If such a ground exists, evidence of self-cleaning measures to restore reliability must be provided where applicable. The ESPD also contains other standard exclusion grounds, but the machine-readable notice did not provide a complete list; the exact exclusion grounds must be checked in the tender documents. The bidder must also confirm the availability or electronic accessibility of information on the payment of taxes and social security contributions.
Qualification criteria and exclusion grounds
The machine-readable notice did not include precise selection, suitability or compliance criteria; these must be checked in the tender documents. According to the compliance requirements, the bid must comply with the technical specification, and the bidder must provide a technical description of the offered cables and cable guides, including at least the names, lengths, colours and product codes. Test results for single-mode and multimode optical cables must also be submitted. In the case of a joint bid, a power of attorney from the joint bidders must be attached. The bid must not be conditional, and the bidder must confirm compliance with the tender documents and, where necessary, explain equivalence with supporting evidence. The offered goods must not be subject to international sanctions or originate from sanctioned areas. The bidder must also confirm that it will not involve subcontractors or suppliers representing more than 10% of the contract value if they are linked to a Russian citizen, resident or entity established in the Russian Federation, or are controlled by such a person or entity.
