Compliance requirements
The bidder may be excluded if any of the following apply: criminal convictions of the bidder or its management/representation bodies for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering or terrorist financing; convictions for enabling illegal employment of a foreign national or violating conditions of employment of a foreign national in Estonia, including paying less than the statutory wage; convictions for illegal use of child labour or human trafficking; outstanding tax, fee or environmental charge debts, or social security contribution debts under the law of the bidder’s country of establishment; or if concluding the contract would breach an international sanction or a sanction of the Government of the Republic. The bidder must also confirm that its place of residence or establishment is not in a third country outside the permitted countries. The machine-readable notice did not include any other precise exclusion grounds; these must be checked in the official tender documents.
Qualification criteria and exclusion grounds
The bidder’s net turnover for the last financial year ended by the start date of the last three public procurements must be at least EUR 1,800,000. Joint bidders may aggregate turnover. If the bidder relies on the resources of another undertaking, a jointly signed confirmation must be submitted with the tender stating that the resources are available, their use is permitted, and the parties are jointly and severally liable for the part of performance based on those resources.
To prove technical and professional capability, the bidder must have entered into similar software contracts within the 36 months preceding the start of the procurement. A contract is considered similar if, under it, at least two of the following conditions are met: the bidder has integrated and managed battery storage solutions, solar parks and wind farms; the bidder has managed at least one 52 MWh battery park. These conditions may be met under one contract or two separate contracts. For the reference contracts, the bidder must provide a description of the contract scope, the contract date, the other contracting party’s name and contact details, and, in the case of a public procurement, the reference number. If the bidder relies on another undertaking’s capability, a jointly signed confirmation of that reliance must be submitted.
To demonstrate compliance, the bidder must complete all 6 tabs of the functionality confirmation form and submit a valid ISO 27001 certificate. The bidder must also submit the SLA terms, the life-cycle cost form and the application for participation in the procurement procedure. The machine-readable notice did not include any more precise qualification or compliance requirements; these must be checked in the tender documents.
