Compliance requirements

The machine-readable notice includes the standard exclusion grounds from the procurement passport, including participation in a criminal organisation, corruption, fraud and other mandatory exclusion grounds. The bidder must confirm the required declarations and, where applicable, may provide evidence of self-cleaning. The exact full list and wording of exclusion grounds should be checked in the tender documents.

Qualification criteria and exclusion grounds

The bidder must meet the qualification and compliance requirements set out in the procurement passport and the compliance conditions. The machine-readable notice clearly listed the exclusion grounds, but the substantive qualification requirements on financial capacity, experience or team were not set out in detail; these must be checked in the tender documents. When submitting the bid, the bidder must confirm that the bid complies with the tender documents, submit the completed bid form and price form, technical information material, and a document proving the manufacturer’s or authorised supplier’s right to distribute the offered products. For medical devices, the instructions for use for each product, the manufacturer’s declaration of conformity and, where applicable, the EC certificate of conformity must be included. If an equivalent product is offered, equivalence must be explained and supporting evidence attached. In a joint bid, a power of attorney for the joint bidders must be submitted. The bidder must also confirm that it will not use subcontractors or suppliers linked to the Russian Federation for more than 10% of the contract value, and that the offered goods are not subject to international sanctions and do not originate from sanctioned territories.
