Compliance requirements
The notice includes exclusion grounds for criminal organisation participation and other standard criminal-conviction grounds for the bidder and, where relevant, for first-tier subcontractors. If an exclusion ground applies, the bidder may have to show self-cleaning measures. The machine-readable notice did not include the full list of exclusion grounds, so the official tender documents must be checked.
Qualification criteria and exclusion grounds
The bidder must be registered in the commercial register. A company registered in another country must attach proof of registration in its home-country commercial register and proof that it is registered for the activity related to the subject of the contract. For an Estonian company, the contracting authority checks the registration itself.
The bidder’s net turnover for the last three financial years preceding the start of the procurement must total at least EUR 4,800,000 excluding VAT. The turnover data must be provided in the ESPD.
The bid must confirm that it complies with all conditions set out in the contract notice and the tender documents. Conditional bids are not allowed. If the bid is submitted by a person whose right of representation does not arise from law, a proper power of attorney must be attached. In the case of a joint bid, a power of attorney for the joint bidders must be attached. If subcontractors are used, the bidder must submit an ESPD for them, their consent and information on the share of subcontracted work as a percentage of the total contract value.
The tender guarantee must be EUR 25,000 and its validity period must be equal to the validity period of the bid. The guarantee may be either a deposit of the amount to the contracting authority’s account or a guarantee issued by a credit, financial or insurance institution.
