Compliance requirements

The bidder and its managers, representatives or persons with authority to represent, decide for or control the bidder must not have final convictions in the last five years for the listed exclusion grounds, including participation in a criminal organisation, corruption, fraud and the other mandatory grounds set out in the tender documents. If an exclusion ground applies, the bidder may have to show self-cleaning measures. The machine-readable notice did not include the full precise list of exclusion grounds; the exact requirements must be checked in the official tender documents.

Qualification criteria and exclusion grounds

The bidder must meet both economic and technical capacity requirements. The minimum economic requirement is that the net turnover for the last financial year ended by the start of the procurement must be at least EUR 70,000. Joint bidders may combine turnover figures. If needed, the bidder must provide the latest annual report or other evidence if the data are not publicly available to the contracting authority. As regards technical capacity, the bidder must have performed at least one contract or order for the provision of testing services involving accredited or non-accredited tests within the last 36 months. The bidder may also rely on previous accredited or non-accredited tests carried out as part of material verification on projects. If the bidder relies on the capacities of another company, the details of that entity and, upon request, the corresponding consent must be provided. If the bidder states that it has accreditation for tests requiring accreditation, it must have a testing laboratory accredited under EVS-EN ISO/IEC 17025 and submit a copy of a valid accreditation certificate. To confirm bid compliance, the bidder must accept all terms set out in the contract notice and tender documents and submit the laboratory test list as the price list.
