Compliance requirements
The bidder must be excluded from the procurement procedure if any of the grounds listed in Section 95(1)(1)–(5) of the Public Procurement Act apply to the bidder or to a member of its management, administrative or supervisory body, a procurator, or another person authorised to represent or control the company: participation in a criminal organisation, corruption, fraud, terrorist offences or related acts, money laundering or terrorist financing; enabling the employment of a foreign national staying in the country without legal basis or violating the conditions for employing a foreign national, including paying less than the statutory wage; illegal use of child labour or human trafficking; tax, fee or environmental charge arrears, or tax or social security contribution arrears in the country of establishment; or a breach of international sanctions.
The bidder must confirm that none of these exclusion grounds apply to it.
Qualification criteria and exclusion grounds
The bidder must be entered in the business register of its country of establishment if this is required by the laws of that country. If registration is required, the bidder must provide an appropriate copy of proof of registration, except where the bidder is established in Estonia.
The bidder and/or its subcontractor must have completed at least one contract during the 60 months before the start of the procurement with a total value of at least EUR 300,000. The contract must have covered design work for a technological system for crushing mineral materials or rocks, and must have used at least crushers, conveyors and a bulk material loading system. A list of the main contracts, including their value, dates and the other contracting parties, must be submitted.
The bidder’s team must include at least one person responsible for design who holds at least a level 7 certified civil engineer qualification with design management competence, or an equivalent qualification, and at least one designer who holds at least a level 6 certified electrical engineer qualification with design competence, or an equivalent qualification, or at least a B-competence certificate covering design, or an equivalent qualification. A list of the responsible persons and copies of documents proving their qualifications and competence must be submitted. A foreign bidder or its foreign subcontractor must, where necessary, provide equivalent documents from its country of establishment and a confirmation that within one month after contract signature it will submit the confirmation issued by the Consumer Protection and Technical Regulatory Authority regarding the above-mentioned responsible person’s qualification and competence.
