Compliance requirements
The machine-readable notice includes mandatory exclusion grounds for criminal organisation participation, corruption and other standard conviction-based grounds in the ESPD. If an exclusion ground applies, the bidder may need to provide details of the conviction, the exclusion period, and any self-cleaning measures. The notice also refers to the possibility of rehabilitation where allowed by law or the tender documents. Precise exclusion grounds and any additional confirmations must be checked in the official tender documents.
Qualification criteria and exclusion grounds
The qualification and suitability requirements are set out mainly in the ESPD and the exact requirements must be checked in the tender documents. In the ESPD, the bidder must confirm that it is not affected by the mandatory exclusion grounds, including participation in a criminal organisation, corruption and other conviction-based grounds. If an exclusion ground applies, the bidder may need to provide the conviction date, reason, details of the convicted person, the exclusion period, self-cleaning measures and evidence of those measures. Under the compliance requirements, the bidder must confirm that it will not use subcontractors or suppliers accounting for more than 10% of the contract value if they are Russian nationals, residents or entities established in the Russian Federation, or persons linked to them. The bidder must also be the official representative and/or official distributor of the offered product and submit a document proving the manufacturer’s authorisation. In a joint bid, an authorised representative must be appointed and a power of attorney from the joint bidders must be attached. The bid must comply with the tender documents and be submitted using the required forms, including the completed technical specification and price forms.
