The bidder must confirm that none of the exclusion grounds listed in Section 95(1), Section 95(4) point 8, and Section 95(4) prim of the Public Procurement Act apply to it. The person responsible for managing the design works must hold at least a certified road engineer qualification, or an equivalent EQF qualification, at level 7 or higher, in the field of design management. The same person may also serve as the person responsible for the design works if both role requirements are met. The same person may also serve as the design project manager if both role requirements are met. The bidder must also provide the details of the legal representative or authorised representative in accordance with the bid submission rules. In a joint bid, the joint representative must be appointed and the share and nature of each participant’s part of the contract must be described. If the bidder relies on another entity’s resources, it must submit that entity’s consent, its details, and confirmation that the entity has no exclusion grounds and meets the qualification criteria relied upon. The bid must comply with the tender documents, and any equivalence must be explained and supported by evidence where needed. The bid price must be submitted in the required structure. If the bid contains trade secrets, they must be briefly described and justified; the bid price and other numerical indicators used for evaluation may not be marked as trade secrets.
