Compliance requirements
The bidder must confirm the mandatory exclusion grounds, including no final conviction in the last five years for participation in a criminal organisation, corruption, fraud and the other exclusion grounds listed in the tender passport. If an exclusion ground applies, the bidder may have to show self-cleaning measures. The machine-readable notice did not include the full precise list, so the exact exclusion grounds must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder’s average annual net turnover for the last three completed financial years must be at least EUR 10,000 for the period 01/01/2023–31/12/2025. The bidder must provide a confirmation of this and, upon request by the contracting authority, an extract from the accounts or other proof. The person responsible for managing the service, i.e. the project manager, must hold a professional qualification as a road engineer with specialisation in road construction and maintenance and competence in design or project expert assessment, or an equivalent EKR/EQF qualification at least at level 7, except for an initial qualification. The bidder must submit the project manager’s details in the tender passport and, upon request, the documents proving the qualification. The tender must comply with all tender document requirements, be submitted in the required price structure and include the Annex 2 form. If the bid is submitted jointly, a power of attorney must be attached and, where relevant, information on the size and nature of each joint bidder’s share must be provided. The bidder must also confirm that no subcontractor subject to replacement under Section 122(7) of the Public Procurement Act will be used and that subcontractors or suppliers linked to the Russian Federation will not account for more than 10% of the contract value. The machine-readable notice did not include any more precise qualification requirements; these must be checked in the tender documents or tender passport. The bidder must also comply with the tender compliance requirements and submit the required price form and confirmations.
