Compliance requirements

The tender documents state mandatory and voluntary exclusion grounds. The bidder must confirm that none of the mandatory grounds apply, including convictions for participation in a criminal organisation, corruption, fraud, terrorism-related offences, money laundering or terrorist financing, illegal employment of foreigners, child labour or human trafficking, tax or social security debt, or a breach of international or government sanctions. The bidder must also confirm that no voluntary exclusion ground applies, such as serious breaches of environmental, social or labour obligations, bankruptcy or liquidation, serious professional misconduct, collusion, conflict of interest, misleading conduct, prior serious contract breaches, false statements, tax offences, or lack of legal right to submit a tender. The notice also includes confirmations on Russia/Belarus-related restrictions, subcontractors and suppliers, and sanctions-related goods.

Qualification criteria and exclusion grounds

The bidder’s net turnover for each of the last three completed financial years must be at least EUR 700,000. An extract from the reports for the last three completed financial years must be submitted showing the turnover; this requirement does not apply if the data for a legal entity registered in Estonia are publicly available to the contracting authority. At least six months must have passed since the end of the last completed financial year as of the bid submission date. The bidder must be accredited under EVS-EN ISO/IEC 17020:2012 or an equivalent standard, and the accreditation scope must cover calibration of active electricity meters in a permanent laboratory. A copy of the accreditation certificate must be submitted, and proving equivalence is the bidder’s responsibility. The bidder must have a permanent laboratory for performing the service, and the address of the calibration laboratory must be provided. The bidder must also have a meter reception point in Tallinn, and its address must be provided. All employees who communicate with the contracting authority and other parties affected by the performance of the service must have oral and written Estonian language skills at least at B2 level. The contracting authority may request additional evidence. When submitting the bid, the bidder must confirm that the bid complies with the tender documents and provide the names, job titles and contact details of the person(s) signing the contract, as well as the contact person’s details for matters related to contract performance. If the right of representation does not arise from the articles of association, a power of attorney must be included. The bidder must also choose the invoice payment term: 45 or 95 calendar days; if 95 days is chosen, the bidder must join the contracting authority’s factoring programme.
