Compliance requirements
The contracting authority will exclude a bidder if any of the exclusion grounds under Section 95(1) of the Public Procurement Act apply. For foreign companies, the bidder must submit documents confirming the absence of exclusion grounds for the foreign company and, where relevant, for its board, supervisory board and other persons authorised to represent or control it. If the authority cannot verify the information from public registers, it may request additional documents. The machine-readable notice did not include any more precise exclusion requirements; they must be checked in the official tender documents.
Qualification criteria and exclusion grounds
The bidder’s total net turnover for the last three completed financial years before the start of the procurement must be at least EUR 450,000 excluding VAT, with at least EUR 150,000 in each year. If the bidder is not registered in Estonia or the contracting authority cannot verify the data from public sources, extracts from annual reports or other evidence must be submitted. Joint bidders may rely on each other’s figures.
The bidder must have properly performed at least one contract for construction works at a substation with a voltage of 110 kV or higher within the 60 months preceding the date on which the procurement procedure started, and that contract must have included secondary system works and delivery of secondary system equipment. The contract value must have been at least EUR 100,000. The exact requirement continues in the tender documents because part of the machine-readable text was truncated.
When submitting the offer, the bidder must confirm that it has reviewed all tender conditions, has the necessary intellectual property and personal data processing rights, and that the offered goods are new, unused, defect-free and comply with the technical requirements. If the person signing the offer is not the legal representative, a power of attorney must be submitted. In a joint bid, the joint bidders’ power of attorney and confirmation must be submitted. The price schedule must be submitted in the required form in euros excluding VAT.
