Compliance requirements
The bidder and its management body members must not have been finally convicted within the last five years for participation in a criminal organisation, corruption, fraud, terrorist offences, money laundering, child labour or human trafficking, or for any other exclusion grounds listed in the tender documents. If such a ground exists, the bidder may submit evidence of self-cleaning measures where permitted. The bidder must also confirm that the offered goods are not subject to international sanctions and do not originate from sanctioned territories, and that it does not use subcontractors or suppliers linked to the Russian Federation for more than 10% of the contract value in line with the sanctions rules.
Qualification criteria and exclusion grounds
The machine-readable notice did not include precise qualification or suitability criteria; these must be checked in the tender documents. The ESPD indicates that the bidder must provide the required declarations and evidence concerning exclusion grounds, joint bidding, reliance on the capacities of other entities, subcontractors, tax payment, and the choice of lots. Under the compliance requirements, the bidder must submit a completed participation declaration, a completed bid form, technical information, evidence of authorization to distribute the offered products or a copy of it, the packaging label for each offered product, and for medical devices also the instructions for use, declaration of conformity and, where applicable, an EC certificate. The bid price must be submitted according to the prescribed structure using the price form. The bid must comply with the tender documents, and equivalence must be explained and supported where necessary.
