Compliance requirements
The bidder must confirm the mandatory exclusion grounds, including no final conviction in the last five years for participation in a criminal organisation, corruption, fraud, money laundering or terrorist financing, child labour or other forms of human trafficking, terrorist offences, and other listed criminal-law grounds. The bidder must also confirm that it does not use a subcontractor that would have to be replaced under the Public Procurement Act. If an exclusion ground exists, the bidder may need to provide evidence of self-cleaning where allowed. The exact list and any detailed confirmations must be checked in the tender documents.
Qualification criteria and exclusion grounds
The bidder’s total annual turnover for each of the last three financial years ended by the start date of the relevant procurement must be at least EUR 300,000 per year. If the bidder relies on the capacities of other entities, the necessary information about those entities must also be provided. The contracting authority may request an extract from the annual accounts or other proof of turnover. To ensure tender compliance, the bidder must confirm that the tender complies with the procurement documents, that equivalence has been explained where necessary, and that supporting evidence has been attached. By the latest at contract signature, the bidder must have in the business register the activity ‘Construction’ with the specific classification ‘general construction work’ and the activity ‘Heritage protection’ with the specific classification ‘conservation and restoration of a building located on a monument or world heritage site’, or an equivalent registration or licence under the law of the country of establishment. If the bidder is not established in Estonia, it must provide, before contract signature, a certificate from the competent authority of its country of establishment confirming the registration or licence. In the case of a joint tender, a power of attorney for the joint bidders’ representative must be submitted. The bidder must also confirm that it will not use a subcontractor in contract performance that would have to be replaced, and that the offered goods are not subject to international sanctions and do not originate from sanctioned areas.
